On Tuesday, Elon Musk amended his court case against OpenAI and its CEO Sam Altman, clarifying that any ill-gotten gains recovered should be returned not to him but to the nonprofit arm of the AI firm he co-founded. His lawyer, Marc Toberoff, stated unequivocally: 'Musk is not seeking a single dollar for himself.'
Toberoff elaborated to The Wall Street Journal that Musk's new strategy seeks to return all ill-gotten gains to the public charity and ensure those responsible can never do so again. This move comes after US District Judge Yvonne Gonzalez Rogers issued an order that risked severely limiting Musk's remedies if he did not alter his approach.
The judge denied Musk's request for punitive damages and agreed with defendants that Musk’s expert, who calculated potential wrongful gains of $134 billion, failed to support Musk's arguments. This shift in strategy suggests Musk is adapting to maintain the lawsuit's viability.
Musk’s legal theories are now focusing on ensuring any benefits gained from his contributions are used for their intended charitable purposes. His pivot highlights a strategic move not just for personal gain but also to protect the integrity of the AI research community.
